Monetary penalties issued by the Information Commissioner’s Office to organisations over the past 12 months has increased by over 200%, with 2012 being the most abundant year for serious enforcement action.

The ICO actions in 2012 included 25 fines, 3 enforcement notices, 6 criminal prosecutions and 31 undertakings.  When compared with 2011 it can be noted that the ICO are increasing the fines issued and failure to comply with the data protection laws are not being looked upon lightly.

Research has shown that data security breaches accounted for 88% of the fines issued in 2012, with 80% of those fines issued to the public sector.

The ICO will continue to take enforcement action seriously in 2013, within the public and private sectors, for failures to comply with the data protection act.
